Former Leader of Opposition and BJP MLA Vijender Gupta has challenged in the Delhi High Court the order of the Speaker suspending him from the Delhi Legislative Assembly for one year. Senior advocate Jayant Mehta, appearing for Gupta, sought an urgent hearing before a bench of Chief Justice Satish Chandra Sharma and Justice Sachin Dutta. Accepting the request, the court said that the matter would be heard tomorrow.
In the petition, Gupta has argued that the Speaker’s order is unjust, unreasonable and has been passed in violation of the rules of procedure and conduct of the Legislative Assembly of the National Capital Territory of Delhi.
The action of the Hon’ble Speaker in allowing the petitioner to move and proceed with the motion to suspend the petitioner from the House for a period of one year does not fall within the definition of irregular proceedings but in fact deserves to be classified as illegal and unconstitutional. An excellent case. This violates the fundamental rights of the petitioner under Articles 14 and 19 of the Constitution of India.
Gupta further said that the behavior of the AAP members was very disorderly. A perusal of the proceedings of the entire day i.e. 21st March clearly shows that the action of the Hon’ble Speaker to treat the ruling party MLAs and the petitioner who are members of the opposition party differently is completely arbitrary.
Delhi Assembly Speaker Ram Niwas Goel barred Gupta from participating in the proceedings of the House till the next budget session. Goyal has taken this decision on the proposal of suspension of Gupta by AAP MLA Sanjeev Jha. Sanjeev Jha alleged that Gupta was repeatedly obstructing the proceedings of the House.
Earlier in the day, Gupta had written a letter to the Speaker proposing a breach of privilege motion against Finance Minister Kailash Gehlot and Environment Minister Gopal Rai for leaking the budget details on social media before presenting them in the House. Had given.
